House Bill HB-1108:
Motorcycle Profiling by Peace Officers

TALKING POINTS
Motorcycle related profiling is an initiated stop by law enforcement based on a person operating a motorcycle or wearing motorcycle related clothing rather than behavior or criminal activity.
An extended stop without probable cause or a stop based on profiling should be strictly prohibited and corrective action must be taken if found to be in violation.
There must be a clear, written process for filing a complaint.
There must be legislation and education among all Law Enforcement Agencies that promote awareness and a prohibition of profiling.
There is evidence that profiling exists on a large scale nationally through resources like the national profiling project.

Texas Gang Database Transparency & Accountability Act

TALKING POINTS
Must be subject to audit and judicial review and cannot be included in the database without probable cause.
There must be formal notification regarding the inclusion to the gang database and a description of the process for removal.
There should be a prohibition for release of information and cannot be used as a determination of employment.
Cannot be used to limit the rights to the individual under the constitution and cannot be used to restrict licensing.

The right to repair requires a manufacturer to provide to an owner information regarding diagnostics, repair, service, calibration or recalibration parts and systems of the vehicle.
Cannot impair an owner or aftermarket parts manufacturer for making compatible aftermarket parts.
Cannot mandate the use of a tool.
NHTSA must issue standards for access to vehicle data..

Maintain an individual’s freedom to choose between an electric powered vehicle or a vehicle powered by an internal combustion engine.
Not mandate driven.
Air quality nor air challenges cannot restrict a citizens freedom of choice.
No agency shall restrict based on energy source.
No agency shall limit or prohibit the sale of a new vehicle with an internal combustion engine.

Stay focused on the legislation we are presenting. The more people that show up speaking to our legislation, the more they will remember us and our bills.
Lobbying is sharing your opinion and presenting yourself as the expert.
What you are doing is constitutionally protected under the 1st Amendment
– Petition to redress grievances
– The inability to redress grievances was one of the specific reasons the Declaration of Independence was signed.
Be authentic. Be polite. You don’t have to wear a suit to go into the Capitol.
Don’t get your feelings hurt if you can’t speak directly to the representative. Those “kids” you are talking to could make or break your legislation.
The Motorcycle Riders Foundation (MRF) represents “ALL” motorcyclists in Texas. We currently have over 400,000 and 80% = 320,000 votes.
Never give up. Keep showing up. Every time you show up, they will remember you…….They will remember us. That’s why manpower is so important.
The more that show up and have those conversations, the more memorable the issue will be.
There are literally 1,000s of bills that are being presented. What makes ours any different? This….. this is the difference
Be yourself and you will be effective.
